In Queensland insurers only need to contribute to your legal costs and outlays in certain circumstances.
In WorkCover claims it is a very rare case where WorkCover will contribute to your legal costs and outlays. This may occur if you have a very serious injury but even then the amount WorkCover will contribute is very small.
The situation is different if your claim arises from a motor vehicle accident. In these claims the insurer may be required to pay a fixed amount called “prescribed costs”, normally about $3500 only, or standard costs which may amount to about $20,000. This depends on what your claim settles for. If your claim settles for over approximately $70,000 then the insurer will pay standard costs and this is very helpful to you as it generally means you will receive more money in the hand as most of your legal fees and outlays are paid by the insurer.
If your claim proceeds to trial and you are successful, then different costs scenarios arise depending on the amount of the judgement in your favour. In some matters, the insurer may be required to pay almost all of your legal costs.
