Increasingly, stonemasons and others within the engineered stone industry are being diagnosed with silicosis. This is a lung condition caused by the inhalation of silica dust created when engineered stone is cut without proper precautions.
Engineered stone has become increasingly popular since the early 2000s both for kitchen and bathroom benchtops. It is a cheaper alternative to natural stone such as granite and marble. Unlike granite and marble, engineered stone contains a high silica content.
It has long been known within the industry that silica dust is dangerous and steps such as wet cutting, ventilation and the use of respiratory masks ought to be used to minimise the risk. Unfortunately, this has often not occurred and there are increasing numbers of workers being diagnosed with the silicosis. It is a permanent condition for which there is no cure and is often terminal.
Most claims for damages for silicosis are against the injured worker’s employer and the suppliers and manufacturers of engineered stone. In Queensland, WorkCover Queensland is generally the insurer for the employer and a claim for damages for personal injuries may be brought.
We have recently successfully acted for a client achieving an award well in excess of $1million clear of benefits already paid by WorkCover Queensland. Claims of this nature are specialised due to their unusual and unique nature. As such it is essential to obtain expert advice which we are happy to provide.
