In almost all personal injury claims in Queensland, the insurer will require you to attend a Doctor for its purposes.
The insurer will put a panel of three Doctors to your lawyer and your lawyer will select one of the Doctors. The insurer will make all of the appointment details and your lawyer will inform you of the appointment time, date and place. Your lawyer can not attend the appointment with you.
Obviously, the insurer will use a Doctor who it thinks will assist the defence of your claim. You should, therefore, expect the Doctors report to be unhelpful to your claim and your lawyer will advise you of this.
When you attend the Doctor the Doctor will normally tell you that they are independent and are not there to treat you or answer questions- The Doctor will then look at any scans, ask you questions and examine you.
If you feel as though the Doctor is being rude or dismissive you should not react to this. You would expect that the Doctor will be professional and personable but if you experience something different you should not be alarmed or insulted.
After the appointment, the Doctor will provide a report to the insurer and the insurer will disclose a copy of the report to your lawyer. Your lawyer will provide the report to you and should advise you fully on the relevant conclusions and how the report affects your claim.
The main issues arising from the report will be your bodily impairment, how the injuries will affect your work and the need and costs of any further treatment.
